Storyathon/Writing Legends Terms and Conditions

Welcome to Storyathon/Writing Legends, which is operated by 3P Learning Limited (“Company,” “we,” “us” or “our”). By registering an account for, or using Storyathon/Writing Legends Services, including all of the services provided therein, and any other websites and applications that link to these Terms (collectively, the “Services”), you acknowledge that you have read and understand these Terms, and agree to be bound by them.
The “terms and conditions” governs the use of “Storyathon/Writing Legends services” available from the domains www.storyathon.com and www.writinglegends.com. The Storyathon/Writing Legends Terms and Conditions should be read in conjunction with the Storyathon/Writing Legends Privacy Policy which together form the full terms and conditions of Storyathon/Writing Legends’s agreement with the User.

Storyathon/Writing Legends’s Trademarks, Logos, Graphics, Audio or Other Assets
- Unless otherwise stated the User may not use or alter Storyathon/Writing Legends’s trademarks, logos, graphics, audio or other assets included in Storyathon/Writing Legends Services in any way other than for their intended purposes.
- Schools are granted permission to use Storyathon/Writing Legends logo to promote the event within their school.

Reservation of Rights
- Storyathon/Writing Legends reserves all right, title and interest in Storyathon/Writing Legends Services (including all characters, storyline, images, photographs, animations, video, audio, music, text), and all associated copyrights, trademarks, and other intellectual property rights therein.
- The User may not decompile, disassemble, or reverse engineer Storyathon/Writing Legends Services, or any component thereof, by any means whatsoever.
- The User may not “hack” or intentionally degrade Storyathon/Writing Legends Services.
- The User may not remove, alter, or obscure any product identification, copyright, or other intellectual property notices in Storyathon/Writing Legends Services. All rights not expressly granted herein are reserved by Storyathon/Writing Legends.

Storyathon/Writing Legends Services Uptime
- Storyathon/Writing Legends takes all reasonable steps to ensure Storyathon/Writing Legends Services are available 24 hours every day. However, websites and other online applications sometimes encounter downtime due to server and other technical issues. Storyathon/Writing Legends will not be liable if Storyathon/Writing Legends Services are unavailable at any time.
- Where possible Storyathon/Writing Legends will try to give advance warning of maintenance issues but shall not be obliged to do so.

Responsibilities of Users
- It is the responsibility of each user to maintain the confidentiality of their account password.
- It is the responsibility of every User to in no way try to “hack” or intentionally degrade Storyathon/Writing Legends Services.

Material the User sends to Storyathon/Writing Legends or posts on Storyathon/Writing Legends Services
- With the exception of personally identifiable information (see Storyathon/Writing Legends Privacy Policy), any material the User sends to Storyathon/Writing Legends or posts Storyathon/Writing Legends Services shall be considered
non-proprietary and not confidential. Unless the User advises to the contrary Storyathon/Writing Legends will be free to copy, disclose, distribute, incorporate and otherwise use such material for any and all purposes.
By creating stories on Storyathon/Writing Legends you are granting us a permanent, non-exclusive right to publish the stories in both digital and printed format. Users retain creative ownership of their stories and they may publish them anywhere else they may wish. Users will not be entitled to any payments or royalties for any publishing we may do of stories they have submitted on the Storyathon/Writing Legends site. We may contact the teacher of a student if the content of a story is concerning. Examples of these may include, but not limited to, self-harm, excessive violence or abuse. We do not read the content of most stories and it is not possible to detect all instances of concerning content. Stories submitted on the site may be analysed in non-identifiable ways for research purposes.
- With the exception of personally identifiable information (see Storyathon/Writing Legends Privacy Policy), any material the User sends to Storyathon/Writing Legends or posts Storyathon/Writing Legends Services shall be considered

Storyathon/Writing Legends is not responsible for the content on any linked third party website. If the User chooses to access a third party website linked to from any Storyathon/Writing Legends service, it is at the User’s own risk. The User is encouraged to notify Storyathon/Writing Legends if there are any inappropriate links on Storyathon/Writing Legends services.

Storyathon/Writing Legends may make changes to the material contained within Storyathon/Writing Legends Services at any time and without notice.
- Storyathon/Writing Legends takes all reasonable care to ensure the maintenance and security of the User’s data. However, Storyathon/Writing Legends does not guarantee the data. Storyathon/Writing Legends accepts no responsibility for a temporary or permanent loss of data.

Maximum Liability
- The User agrees that Storyathon/Writing Legends is financially liable only to the amount the User has paid in the preceding 12 months.
- The User agrees that Storyathon/Writing Legends shall not be liable for any consequential damages.
- The User agrees that none of the Supporting Partners of Storyathon/Writing Legends are liable in any way.

Governing Jurisdiction
The User may provide a link to Storyathon/Writing Legends services on another website on the basis that:
- Storyathon/Writing Legends Terms and Conditions shall be governed by and construed in accordance within Australian law. Any dispute(s) arising in connection with this Legal Notice are subject to the exclusive jurisdiction of Australian Capital Territory.
